- ABSTRACT The paper breafly presents the action of the psychologists in the Courts of Penal Execution, highlighting the differences of the labor insertion to the moment to work with imprisoned persons and with those that preserve the life at liberty. Later there is realized a synthesis of the prison situation based on the statistics Penitentiary Federal Service and of the Penitentiary Buenos Aires Service. Likewise, a reflection takes place brings over of the conditions of accumulation, ill-treatment and tortures that are observed in the centers of privation of the freedom, according to information contributed by a report of the Inter-American Commission of Human Rights (ICHR). In this regard, it is that it puts in consideration on the utilization of the preventive detention in to the area of the Justice and its impact in the subjectivity. Finally there is highlighted the importance of the Alternative Measures to the Privation of the Freedom (AMPF), and especially the Suspension of Judgment to Test (Probation), not only for a better administration of justice but in addition to put in consideration the benefits for the persons who cross these measures in terms of subjective earnings.
RESUMEN
Se presenta brevemente la actuación de los psicólogos en los Juzgados de Ejecución Penal, resaltando las diferencias de la inserción laboral al momento de trabajar con personas encarceladas y con aquellas que preservan la vida en libertad.
A continuación se realiza una síntesis de la situación carcelaria en cuanto las ultimas estadísticas a nivel nacional y del Servicio Penitenciario Bonaerense. Así mismo, se produce una reflexión acerca de las condiciones de hacinamiento, malos tratos y torturas que se observan en los centros de privación de la libertad, según datos aportados por un informe de la Comisión Interamericana de Derechos Humanos (CIDH). A este respecto, es que se pone en consideración la
utilización de la prisión preventiva en al ámbito de la Justicia y su impacto en la subjetividad. Finalmente se resalta la importancia de las Medidas Alternativas a la Privación de la Libertad (MAPL), y en particular la Suspensión de Juicio a Prueba (Probation), no sólo para una mejor administración de justicia sino además para poner en consideración los beneficios para las personas que atraviesan estas medidas en términos de ganancias subjetivas.
