Presidencialismo : análisis comparativo constitucional. = Presidentialism: comparative constitutional analysis.

RESUMEN


En trabajos anteriores, en el marco del proyecto UBACyT P048, se analizo la relación entre la psicología de los regímenes políticos y el perfil psicológico de la población (Benbenaste, 2008, 2007). En el presente artículo se realiza un análisis comparativo de las secciones referidas al poder presidencial plasmados en las constituciones francesas, norteamericana y argentina. La justificación se sustenta en el hecho que desde el nacimiento de los Estados Nación en América Latina la configuración presidencialista delineó el perfil de gobierno; el cual, históricamente, en muchas oportunidades derivó en regímenes populistas. Actualmente se menciona al parlamentarismo como una fórmula política prestigiosa para superar cualquier disfuncionalidad del sistema presidencial local. Esta expectativa parlamentarista lleva el supuesto de que derrumbando al presidencialismo todo quedaría resuelto, desde esta perspectiva se olvida lo fundamental a saber: sin controles instituciones ni uno u otro sistema de gobierno garantiza el sistema republicana. Es decir, sin estructuras republicanas consolidadas el sistema presidencialista o parlamentario deviene en gobiernos populista que pueden derivar en autoritarios.

ABSTRACT


In previous works, within the framework of the project UBACyT P048, I analyze the relation between the psychology of the political regimes and the psychological profile of the population (Benbenaste, 2008, 2007). In the present article a comparative analysis of shaped the sections referred to the presidential power in the French constitutions is made, North American and Argentine. The justification is sustained in the fact that from the birth of the States Nation in Latin America the presidencialis configuration delineated the government profile; which, historically, divert in regimes Populists. Nowadays the parliamentarism it is admired to be as a prestigious political formula but also like a fantastic and definitive remedy to surpass any disfunctionality of the local presidential system. Behind this parliamentaristic mythology there is an important dose of constitutional fantasy, supposing that collapsing to the presidencialism everything it would be resolute, and omitting that without division of powers and controls institutions neither one or another system of government guarantees the republican democracy. In other words, without consolidated republican structures the presidencialistic or parliamentary system became authoritarian governments.
